SWEEPSTAKES SCAM WARNING This is a legitimate sweepstakes. We will contact you by the email address, phone number, or mailing address you provided upon entry. You will be notified only by the Sponsor listed in these rules. Ensure that any email notice from GRIND HARD PLUMBING CO has the domain “@grindhardplumbingco.com”. We will never ask you to pay anything to receive a prize. We will never request your bank account or credit card information. You may be required to complete a U.S. tax form and provide your Social Security Number. You may also be required to complete and notarize affidavits and releases. If you receive a notification that you are a potential winner of this sweepstakes and suspect it might be a scam, please contact us at contact@grindhardplumbingco.com.

PROMOTION PERIOD: The GRIND HARD PLUMBING CO TACOMA GIVEAWAY (the “Sweepstakes”) begins on Friday November 8th 2024 at 12 PM and ends on Sunday December 29th 2024 at 11:59 PM 2024 (the “Promotion Period”).

ELIGIBILITY: Open to legal residents of the world and the 50 United States and District of Columbia, 18 years of age or older at time of entry. Void in U.S. territories and where prohibited or restricted by law. Employees, board members, advisory committee members, directors, officers, or agents of Grind Hard Plumbing Co LLC (the “Sponsor”), their affiliates, subsidiaries, advertising and promotion agencies, or any other suppliers to Sponsor and the immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and persons living in households of each, whether or not related are ineligible. All federal, state, provincial and local laws and regulations apply.

HOW TO ENTER: There are three ways to enter:

1) Eligible individuals who make an online purchase on GRIND HARD PLUMBING CO’S website at www.grindhardplumbingco.com will receive one (1) automatic Sweepstakes entry for each $5.00 spent (example: purchase $100 of product from www.grindhardplumbingco.com and receive 20 entries into the Sweepstakes). No limit on number of entries received with a purchase on www.grindhardplumbingco.com.

2) Mail-in entry: To enter the Promotion by mail without making a purchase, during the Promotion Period, handprint full name, complete street address, telephone number, email address, and birth year on a 4″ x 6″ piece of paper and mail it to: Grind Hard Plumbing Co, PO Box 2370, Sandpoint, ID, 83864. You will receive 1 (one) entry into the Promotion for each Mail-in Entry received. Only one (1) entry allowed per mailed piece. Mail-in Entry requests must be postmarked during the Promotion Period and received by December 30, 2024. LIMIT ONE HUNDRED (100) TOTAL ENTRIES, PER PERSON/EMAIL ADDRESS, REGARDLESS METHOD OF ENTRY. ENTRANTS THAT SEND IN MORE THAN THE MAXIMUM NUMBER OF ENTRIES WILL BE DISQUALIFIED.

3) Members of the Premium Member club are entitled to receiving 2 automatic entries

FINALISTS DRAWING: On or about January 5, 2025, in Sandpoint, Idaho, a random drawing will be conducted to select ten (10) finalists (the “Finalists”) from among all eligible entries received during the entire Promotion Period.

GRAND PRIZE DRAWING: On or about January 5, 2025, in a location in the United States to be determined by the Sponsor, the Sponsor will randomly select one (1) Grand Prize winner from among all Finalists (the “Grand Prize Drawing”). The process for random selection and the location of the Grand Prize Drawing shall be determined solely by the Sponsor. Odds of winning a Grand Prize depend on the number of eligible entries received.

All characteristics and features of the prize(s) except as otherwise explicitly stated above are at the Sponsor’s sole and absolute discretion. No substitution, cash redemption, sale or transfer of prize(s) is permitted except at Sponsor’s sole discretion or as provided herein. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute such prize (or portion thereof) with an equivalent prize of equal or greater value. PRIZE(S) IS AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED. WINNER(S) OF PRIZE(S) AGREES THAT SPONSOR, AND THE PROMOTION PARTIES, HAVE NEITHER MADE NOR ARE RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZE(S), INCLUDING BUT NOT LIMITED TO ITS QUALITY, CONDITION, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. All federal, state/provincial/territorial and local taxes, and all other costs associated with acceptance or use of the prize(s), are the sole responsibility of the applicable winner(s). You are not a winner until your prize claim is validated and you receive official written notification from the Sponsor. Arrangements for delivery of prize(s) will be made after winner validation. LIMIT ONE (1) PRIZE PER PERSON/EMAIL ADDRESS/HOUSEHOLD. Prize(s) will be awarded only to an address within the Territory provided they are claimed properly in accordance with these Official Rules. At the Sponsor’s discretion, prize(s) that are not claimed properly in accordance with these Official Rules may not be awarded. In no event will more than the stated number of prizes be awarded.

ADDITIONAL TERMS FOR GRAND PRIZE WINNER: All characteristics and features of the vehicle prize (including, but not limited to, color of exterior and interior, and options) except as otherwise explicitly stated above are at the Sponsor’s sole and absolute discretion. If required by law, winner of vehicle must be a licensed driver and will be required to provide proof of insurance at time of delivery; failure to do so may result in disqualification. Winner of vehicle prize is responsible for license, title, registration, insurance, transportation, import and export taxes, and other fees associated with the vehicle prize. 

ODDS OF WINNING: Odds of winning a prize depend on the number of eligible entries received.

ENTRANT VERIFICATION: In the event of a dispute regarding the identity of the person submitting an entry, the entry will be declared made by the natural person in whose name the entry was made. The right to require proof of identity and/or eligibility (in a form acceptable to the Promotion Administrator – including, without limitation, government issued photo identification) for any reason deemed necessary, is reserved, for the purposes of administering this Promotion in accordance with these Official Rules. Failure to provide such proof to the complete satisfaction of the Promotion Administrator within the timeline specified may result in disqualification.

DISQUALIFICATION: Entries which are incomplete, incorrect, incomprehensible, not received, or do not otherwise comply with these Official Rules will be void and will not be entered into the Promotion's prize drawing(s). Entries made by facsimile, overnight courier, automated means, any entry service, or in any other manner not specifically allowed under these Official Rules will not be entered into the Promotion and may result in disqualification of the entries and the responsible entrant(s). The right to disqualify any individual who tampers with or attempts to tamper with the entry process or who acts in a disruptive or unfair manner or who otherwise fails to comply with these Official Rules is reserved.

GENERAL RULES: Potential Winner will be notified by email and/or via phone call. Winner may be required to sign and return an Affidavit of Eligibility /Publicity and Liability Release, and W9 (where legal and where required) within 24 hours of notification attempt or prize will be forfeited and an alternate. Winner determined at random from among all eligible entries. If the potential Winner does not return the required documents within the stated timeframe, the corresponding winner will be disqualified and an alternate Winner will be selected. Should the potential Winner (or any other alternate potential Winner) decide to decline the prize for any reason whatsoever, Sponsor shall have no further obligation to that potential Winner, and an alternate potential Winner will be selected, if time permits. Taxes related to the prize are the sole responsibility of the Winner. Acceptance of a prize constitutes permission to the Sponsor and its agencies to use Winner’s name and/ or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By accepting a prize, Winner agrees to hold Releasees harmless against any and all claims and liability from any accident, loss or injury occurring from this promotion or in any way related to the prize or use/misuse thereof. No substitution or transfer of prize allowed, except at Sponsor’s sole discretion. Releasees shall not be liable for any printing or other errors or for delays in mail service. All entries become the property of Sponsor and will not be acknowledged or returned. By participating in this promotion, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. Any questions, comments or complaints regarding the promotion are to be directed to the Sponsor at the address below. By entering sweepstakes, you agree: (a) to be bound by these Official Rules and by all applicable laws and decisions of Sponsor, which shall be binding and final; (b) to waive any rights to claim ambiguity with respect to these Official Rules; (c) to waive all of your rights to bring any claim, action, or proceeding against any of the Released Parties in connection with that sweepstakes; and (d) to forever and irrevocably agree to release, defend, indemnify, and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with your participation in a sweepstakes (including any Prize).

LIMITATIONS: To the fullest extent permitted by applicable law, Promotion Parties are not responsible for: (i) electronic or digital transmissions, entries or mail that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, not delivered, or not received by Sponsor or any reason; (ii) mail that is received postage-due; (iii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures (including but not limited to failures or malfunctions of phone lines, mail delivery service, telephone systems or other communications systems), destruction of or unauthorized access to, or alteration of, entries, or for printing, distribution or production errors; (iv) failed or unavailable hardware, network, software or telephone transmissions; (v) damage to entrants' or any person's computer; (vi) causes beyond Promotion Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion; (vii) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Promotion; (viii) any typographical or other error in the printing or advertising related to the Promotion, in the administration or execution of the Promotion, or in the announcement/notification of prize winners; (ix) any human, or other error, which may occur in the promotion or administration of this Promotion; or (x) cheating or fraud by any participant. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, if possible.

MODIFICATION, SUSPENSION AND TERMINATION: If for any reason this Promotion cannot be executed as planned, including but not limited to infection by virus, bugs, tampering, unauthorized intervention, fraud, technical failures, human error, legal mandate, social media mandate, pandemic, epidemic, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, integrity, fairness or proper conduct of this Promotion, or if this Promotion is compromised or becomes corrupted in any way, electronically or otherwise, the right is reserved to void suspect entries/entrants and/or modify, suspend and/or terminate this Promotion, including the selection of winners in a manner deemed fair and reasonable, including the selection of winners in a random drawing from among applicable eligible, non-suspect entries received prior to such modification, suspension or termination. Thereafter, the Sponsor reserves the right to accept no further entries and award no further prizes.

LIMITATION OF LIABILITY AND RELEASES: By participating in this Promotion, entrants agree (and agree to confirm in writing): (a) to the maximum extent permitted by law, that all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; (b) to release, defend, indemnify and hold harmless the Promotion Parties, and their respective successors and assigns from and against any liability, loss, claim or cause of action whatsoever related to entrant’s participation in this Promotion, including, but not limited to, personal injury, death, or damage to or loss of property arising out of participation in this Promotion or the acceptance, possession, use, inability to use, or misuse of any prize received in this Promotion or the use of any photo, video or entry; and (c) to waive all rights to claim punitive, indirect, incidental and consequential damages, attorneys’ fees, court costs, or any damages other than actual out-of-pocket costs incurred to enter, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO APPLICABLE PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.

MEDIA RELEASE: By accepting a prize or participating in a finalist or prize award activity, each entrant consents to being filmed, recorded, and/or photographed in connection with such activity (collectively “Recordings”) and agrees that the Sponsor will have full ownership rights to such Recordings. Except where prohibited by law, participation in the Promotion constitutes each entrant’s permission for the Sponsor and its affiliates, agents, and agencies to use each entrant’s name, photograph, video, voice, likeness, and any Recordings for advertising, publicity and promotional purposes in all media now known or hereinafter invented, worldwide, in perpetuity, without compensation, notification, or permission.

WAIVERS, DISCLAIMERS, RELEASES, INDEMNITY: BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF- POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIVE DOLLARS (US$5.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF- POCKET EXPENSES NOT TO EXCEED FIVE DOLLARS (US$5.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS' REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. PRIVACY AND INTERNET: Releasees and any Internet access or service providers are not responsible for incorrect or inaccurate entry of entry information, human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, inability to access Websites, or damage to a user's computer system (hardware or software) due to participation in this Sweepstakes. If Sponsor determines, in their sole discretion, that there is any suspected or actual electronic tampering with the Sweepstakes or if technical difficulties compromise the integrity of the Sweepstakes or if any noncompliance with the rules has occurred, Sponsor reserves the right to void the entries at issue and/ or terminate the Sweepstakes and conduct a random drawing to award the Prizes using all eligible, non- suspect entries received in the applicable drawing pool as of the promotion end date. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its end date, notice will be posted at www.grindhardplumbingco.com. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor or its agents. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account” holder is the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any online entries submitted by automated means, or third-party, will be disqualified. Entries will not be valid until received by Sponsor. The personal information collected through this Promotion is subject to Sponsor’s Privacy Policy located at https://www.grindhardplumbingco.com/policies/privacy-policy. In the event of any conflict between these Official Rules and this Privacy Policy, these Official Rules shall control. By entering this Promotion, each entrant agrees that the Sponsor, its agents and/or representatives may store, share and use the personal information he/she submitted with his/her entry for the purpose of administering the Promotion and agrees to the collection, use and disclosure of his/her personal information as described in these Official Rules, in the above Privacy Policy. Your personal data will be collected in the USA. By entering this Promotion, you expressly consent to the transfer of your personal information to countries outside of your country of residence, including without limitation, the USA. As a result, your personal information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

CHOICE OF LAW AND JURISDICTION: This Promotion is offered only where it’s permitted by law and is governed by the laws of the State of Idaho. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Idaho for any action, suit or proceeding arising out of or relating to this Promotion.
